Police ‘Duty to Intervene’ Bill Heads to Governor

Senate lawmakers voted on whether to concur with House Amendments to Substitute Senate Bill 5066, which would create a standard for a peace officer’s duty to intervene when it comes to a fellow officer’s actions.

Senators Mona Das (D-Kent, 47th LD) and Claire Wilson (D-Auburn, 30th LD) were co-sponsors on the bill. Senator Phil Fortunato (R-Auburn, 31st LD) voted against the bill.

Brief Summary of Substitute Bill

  • Requires a peace officer to intervene when witnessing another officer engaging in the use of excessive force.
  • Requires a peace officer to report to a supervisor when he or she witnesses another officer committing wrongdoing.

The Senate voted in concurrence with the House 31-18, which now sends the legislation to the Governor’s office, for an opportunity to be signed into law.
