Mon Jan 31, 12:50 p.m. 2022 PDT An assault between housemates, resulting in arrest, occurred in the 5500 block of 34th Loop SE.

The individual who was arrested was not taken into physical custody. Per the officer’s report, “I considered that [Adult] had [their child] with [them], that making a physical arrest would negatively impact [the child’s] care and that it would potentially exacerbate future encounters between the parties. …It was my opinion that booking [adult] into jail would only serve to create additional problems between the involved parties, and for the [adult’s child]. For these reasons I believed it best to forward charges to prosecution.”

This information is being shared to educate that an arrest does not always mean being taken into physical custody and why that may be.

Had this incident been between adults it would have been considered domestic violence. It was between an adult and a 16-year-old, thus making it ineligible for DV classification. 4th degree Assault will remain on the city level.
